Phoenix police identify man killed in officer-involved shooting

Phoenix police have released body-worn camera footage of the aftermath of an officer-involved shooting in the Maryvale area.

Police said officers responded to a home near 59th Avenue and Indian School Road around 1 p.m. Saturday, July 4 after a caller said a man who tried to kill him a week ago had returned with a knife and was threatening him again. He also said another person had a gun.

Two officers arrived and reportedly saw a suspect sitting in a parked car in a driveway.

Officers approached the car to let the man know they were investigating an aggravated assault.

Police said when the officers asked the man to get out of the car, he rolled up the window and showed a gun.

"Officers ordered the man to drop the gun but he refused," police stated in a release. "The man repeatedly told officers to shoot him and lifted the gun toward officers."

Police said one officer broke the side window of the car to distract the man and two other officers shot him.

The man later died at a hospital. He was identified as James Porter Garcia, 28.

Police said no officers were injured in the incident.

The department released a body-worn camera video clip capturing the moment when the handgun is removed from the suspect’s lap. Investigators are in the process of collecting evidence and completing interviews of everyone who was involved in the incident.

"Releasing body-worn camera (BWC) footage from the officers directly involved before all witness and officer interviews are completed could compromise the investigation," police stated.

A determination as to whether the actions of the officers are within policy will not be made until the investigation is complete and all the facts are known, the department stated in a release.

“We are sharing this video in an effort to address some misinformation about this incident on social media,” the department stated.
