Fired Apache Junction firefighter’s appeal before tribunal postponed

A nearly 25-year employee of the Superstition Fire and Medical District who is appealing his termination from employment before a state agency did not have a scheduled hearing in September as it was postponed to a status update meeting in November.

Brian White, who until earlier this year was a battalion chief, was fired as of March 13.

White appealed the decision for termination of employment and attorneys filed a request March 22 for a hearing before the Arizona Office of Administrative Hearings.

The hearing in the matter of Brian White, appellant, vs. Superstition Fire and Medical District, respondent, was to be Sept. 20-24 on video conferencing Google Meet. It was postponed and a status update has been set for Nov. 19, according to a Sept. 15 minute entry granting continuance signed by Jenna Clark, administrative law judge of the Arizona Office of Administrative Hearings.

“Good cause appearing, the hearing in the above-entitled matter is continued and set for a status update on Friday, Nov. 19, 2021. On or before this date the parties shall submit one of the following stipulated motions to the Office of Administrative Hearings: (1) inform the tribunal that the matter has been satisfactorily resolved by submitting a motion to vacate the hearing; (2) inform the tribunal that the parties need additional time to resolve the matter by submitting a motion to continue and reset for status by 30 days, 45 days or 60 days; or (3) inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing,” it states.

The Superstition Fire and Medical District provides fire suppression, fire prevention, wildland protection, advanced life support, rescue, extrication and medical transportation services out of five fire stations in Apache Junction and Gold Canyon. Under the SFMD governing board’s direction, the district has a budget of $23.7 million through four divisions: emergency services operations, which includes transport; planning and logistics; administrative services; and financial services.
